1. Acceptance of Terms
By accessing MySurplusRx.com or submitting a quote through our service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. We reserve the right to update these terms at any time, and continued use of our service after changes are posted constitutes your acceptance of the revised terms. We recommend reviewing this page periodically to stay informed of any updates.
2. Eligibility
You must be at least 18 years of age and a legal resident of the United States to use our service. By submitting a quote, you confirm that you are the lawful owner of the supplies being sold and that you have the legal right to sell them. Our service is intended for individual sellers, households, caregivers, and licensed businesses operating within the United States. We do not purchase supplies from sellers outside the US at this time.
3. Prohibited Items
We do not purchase supplies that were obtained through, funded by, or billed to Medicare, Medicaid, or any other federal or state government healthcare program — selling such supplies is prohibited by federal law. We also do not accept supplies that are expired, damaged, open, have a broken seal, have been tampered with, are recalled by the manufacturer, or are missing required labeling. All items must be in their original factory-sealed, completely unopened packaging. Submitting prohibited items may result in rejection of your shipment and, in the case of government-funded supplies, referral to appropriate authorities. By submitting a quote, you certify that your supplies are eligible for resale.
4. Quote & Pricing
Quotes generated through our online tool are valid for 7 days from the date of submission. Once you submit a quote and receive a confirmation, your payout amount is locked in and guaranteed — provided the supplies match the description at the time of inspection. Prices are based on current market conditions and are subject to change for future quotes, but a submitted quote will not be reduced unless the physical supplies do not match the submitted description. We reserve the right to adjust the payout if quantities or conditions differ materially from what was stated in the quote.
5. Shipping
We provide a free prepaid USPS shipping label for all accepted quotes. You are responsible for packaging your supplies securely to prevent damage in transit. Supplies should be packed in a sturdy box with items snug and non-shifting; inner packaging must remain intact. All shipments are insured by us against loss or damage in transit — if your package is lost or damaged through no fault of improper packing, we will pay your full quoted amount. You must use the label provided by us and ship only the items listed in your quote.
6. Inspection & Verification
Upon receiving your shipment, our team will inspect and verify the contents promptly. We verify that items match the submitted quote in brand, product type, quantity, condition, and expiration date. We reserve the right to reject any item that does not meet our eligibility standards, including items that are expired, damaged, tampered with, or not included in the original quote. Inspection decisions are final. If you believe an inspection decision was made in error, you may contact us within 5 business days of the decision notice.
7. Payment
Payment for accepted supplies is sent promptly upon verification. You select your preferred payment method (Zelle, PayPal, Venmo, Cash App, or mailed check) at the time of quote submission. Zelle and Cash App payments are typically sent the same day verification is completed. PayPal and Venmo payments are sent by end of business on the verification day. Mailed checks are sent same-day and typically arrive within 3–5 business days. We are not responsible for delays caused by banking systems, third-party payment platforms, or postal service delivery times.
8. Rejected Items
If any item in your shipment is rejected during inspection, we will notify you by email or text promptly after the decision. Rejected items are returned to you free of charge using a prepaid return label within 5 business days of the rejection notice. You will never be charged for return shipping. Items that are not claimed or that cannot be returned due to invalid contact information will be held for 14 days before being disposed of in compliance with applicable regulations. Accepted items in a mixed shipment will still be paid out on the normal schedule.
9. Privacy
Your use of MySurplusRx.com is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our service, you consent to the collection and use of your personal information as described in the Privacy Policy. We take the security of your data seriously and use industry-standard measures to protect it. 10. Limitation of Liability
MySurplusRx and its officers, employees, and affiliates are not liable for any indirect, incidental, special, or consequential damages arising from your use of our service, including but not limited to loss of revenue, loss of data, or business interruption. Our total liability to you for any claim related to our service shall not exceed the payout amount quoted and confirmed for your specific transaction. We make no warranties, express or implied, beyond those explicitly stated in these Terms. Some states do not allow limitation of implied warranties or liability for incidental damages, so the above limitations may not apply to you.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Tarrant County, Texas. By using our service, you consent to personal jurisdiction in those courts. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
